Just over a week after being arrested on sexual assault charges, Webster County Constable Dennis Shelton has been arrested following a second accusation of same crime.
According to the Kentucky State Police Shelton has been charged with Sexual Abuse 1st Degree and Burglary 1st Degree after conducting an investigation.
On Saturday, September 19, 2015 the KSP received information from an adult female that she had been sexually assaulted at her residence in Sebree. The female alleged that Webster County Constable Dennis Shelton came to her residence stating he needed to talk to her. The victim alleged that Constable Shelton entered her residence without her consent and exposed himself.
On Monday, September 21, at approximately 8:25 p.m., the Webster County Sheriff’s Office arrested Dennis A. Shelton, 51, Sebree, on a warrant obtained by the Kentucky State Police. Mr. Shelton was charged with Sexual Abuse 1st Degree (D Felony) and Burglary 1st (B Felony). He was lodged in the Webster County Jail.
Despite the charges against him, Shelton will maintain his status as a Webster County Constable. A statement issued by Webster County Attorney Clint Prow and Judge Executive Jim Townsend states that the Webster County Fiscal court nor any other government entity currently has the power to remove Shelton from his elected office.
“Section 150 of the Kentucky Constitution provides that an elected official may only be removed from office after a felony conviction has been obtained and any appeal finalized,” the statement said. “Therefore, no action can be taken at this time to remove Mr. Shelton as Webster County District Two Constable.”
If Shelton is convicted, it will be in the hands of Commonwealth Attorney Zack Greenwell to take action to remove him from office.
Shelton is scheduled to appear in court on Oct. 6, 2015 at 10:00 a.m. in District Court in Dixon.
